What is the case?
Ranganath’s father N Ramaiah, who was employed with the Karnataka Power Supply Board (KPTCL), went missing since August 07, 2002. Against this background, the application submitted by Ranganath’s mother in 2010 asking for compassionate employment was rejected. Later, Ranganath, who had filed a civil suit due to his father’s disappearance, requested BBMP to order him to issue a death certificate in his father’s name. BBMP had issued a death certificate in Ramaiah’s name on 2011 following the instructions given by the Civil Court after awarding the suit.
In 2012, Ranganath had filed a petition in the High Court, requesting the court to direct KPTCL to provide compassionate employment.
The High Court had directed KPTCL to consider Ranganath’s appeal in accordance with law. KPTCL, who investigated the case, Ranganath’s brother is working in the same organization. So it was said in 2013 that it cannot provide employment to another member of the same family. In 2014, the High Court rejected the petition filed by Ranganath. Ranganath appealed again against this.

What is the High Court order after hearing the appeal?
The Divisional Bench of the High Court which heard Ranganath’s appeal gave the same verdict as before. The High Court said, “When a member of a family is already working in an organization under the government, another member of that family cannot be employed in the same organization on compassionate grounds.”
Further, the High Court clarified that ‘compassionate employment is not a right’, the appellant’s brother is already working in KPTCL. Therefore, the appellant cannot be given another job in the same organization on compassionate grounds.’

Question : Are dependents of deceased employees eligible to get post on compassionate grounds in aided institutions/ educational institutions?
Answer: Dependents of deceased employees of aided institutions are eligible for appointment on compassionate grounds as per Rule 3 of the Karnataka Civil Service (Appointment on Compassionate Basis) Rules, 1996. In the notification dated September 12, 1996, compassionate recruitment regulations were also applicable to aided educational institutions.

Question: A head constable in a police department, later gets promoted to the post of PSI. In case of deputation from the previous place to another place, for what period can one continue in the previously allotted police accommodation? What are the rules about this?
Answer: As per Rule 29(2A) in Schedule 4 of Karnataka Civil Service Rules, vacate the accommodation within one month. Staying longer than that can be charged three times the accommodation rent / license fee. If it stays there for more than 3 months, the public works department can take necessary action and vacate it and charge 5% license fee.
